Pennsylvania Supreme Court Updates Orphans’ Court Rules
Effective January 1, 2020, the Pennsylvania Supreme Court issued several Orphans’ Court rule changes including the following:
Rule 1.7 added a comment that withdrawal of counsel before the Register of Wills is subject to local rules or the discretion of the Register and may be different from the procedure of withdrawal of appearance in the Orphans’ Court.
Rules 1.8 and 10.1 states that forms which differ stylistically, but not in substance, from the court-approved forms, will not be rejected.
Rule 2.1 is amended to require verification of an account “by at least one of the accountants.”
Rule 2.5, mandates, inter alia, notice requirements for filing an account and sets the time period for filing objections by non-U.S. residents.
Rule 4.3 requires that a certificate of service be attached for legal papers.
Rule 7.1 updates authorization for local rules with regard to procedure and subpoenas.
Also, several forms have been updated.
